We’re old enough to remember when the North Miami Police Department’s Internal Affairs division was truly the Office of Professional Compliance.
We’re also old enough to remember when the police department was accredited by the Commission on Accreditation for Law Enforcement Agencies, Inc.
But that was back in the days before Chief Leonard Burgess was appointed as the head of the agency in 2014. That was the beginning of the end.
Let’s recap.
In a state of delusional paranoia, good ol’ Chief Lenny decided to punish the extremely competent Internal Affairs Sergeant Rafael Estrugo by replacing him with Sergeant Diana Roman.
We see how well that worked out.
A year later, the North Miami Police Department FAILED its accreditation assessment for the first time in its history.
And, yeah. That worked out well, too.
Don’t even get us started on Lenny’s disastrous choice of the department’s Public Information Officer!
Everyone was ecstatic when Chief Lenny was finally forced out because of his own incompetence, and especially when Chief Gary Eugene took his place and appointed professional law enforcement officers to his command staff.
This move, of course, did not sit well with Team Juriga, who immediately plotted to undermine Eugene’s appointments.
That euphoria lasted a whole week until that fateful day in July last year when Commander Angel Rivera’s SWAT trained “marksman,” the dubiously hired Officer Jonathan Aledda, inexplicably fired his weapon at Mr. Charles Kinsey.
Who just happened to be an unarmed black man…
With his hands in the air…
Begging cops not to shoot him.
As we can all see, that’s not working out at all, either.
In order to protect their “sharpshooting” protégé, Assistant Chief Larry Juriga, and his toady Commander Angel Rivera, cooked up a scheme to pin the entire blame for the shooting on the shoulders of Chief Eugene’s newly appointed Commander Emile Hollant, who happens to be Haitian. Much to the delight of Juriga and his fellow corrupt ‘Illuminati” members, when Commander Hollant showed up at the incident, he became the commanding officer since he was the highest ranked cop on the scene.
Little did Commander Hollant know, he was immediately targeted by Team Juriga to be the scapegoat for Aledda’s screw up, and that he was about to have the absolute worst year of his career.
Even more frustrating, if it weren’t for the insidious plan executed by a group of corrupt officers, Commander Hollant’s year long nightmare would never have happened.
Let’s review the Internal Affairs Investigative Summary prepared by Diana Roman, which is filled with errors, omissions and inconsistencies, and is literally one hot mess.
Then again, her role in this ongoing drama was to make the charges stick … no matter how contrived the “logic.”
Roman began her report (page 2) with an event that occurred on Friday, July 22, 2016, when she and Assistant Chief Larry Juriga were “summoned to Chief Gary Eugene’s office to review the radio transmission…”
However, Sergeant Roman completely left out the fact that she had already met with Chief Eugene the night before on Thursday, July 21, 2016, when they both listened to those radio transmissions in her office.
In fact, it was right after the meeting with Sergeant Roman on Thursday night that Chief Eugene realized that Jonathan Aledda did not shoot his gun on Hollant’s command since two more police officers announced that the subject did not have a gun, but a toy.
In his testimony to Sergeant Roman (page 7), Chief Eugene stated that “between 8:40 and 8:48 pm” that evening he called City Manager Larry Spring and City Attorney Jeff Cazeau to tell them, “There is some new development. Guys, I know you are tired. There is a CD I would love for you to listen [to]. Please, I’m going to delay the suspension of Commander Hollant until you have a chance to listen to the CD.”
For some odd reason, Roman decided that those facts were irrelevant to her case.
Sergeant Roman continued her narrative by stating that during the July 22, 2016 meeting in which she and Larry Juriga were “summoned to Chief Gary Eugene’s office,” the radio transmissions “revealed that Commander Hollant appears to have been present, prior, during and after the police-involved shooting incident.” She also stated that Hollant was not separated or “interviewed in a timely manner, as other officer witnesses were during the incident.”
Roman also claims that during this meeting, Chief Eugene directed her to “initiate an Internal Affairs investigation for Commander Hollant’s apparent obstruction of a law enforcement investigation.” She also stated that Chief Eugene “advised that Commander Hollant would be placed on administrative leave without pay.”
Before the ink was even dry on his suspension documents, and in an overzealous rush to judgment, City Manager Spring immediately held a press conference to ensure that Commander Hollant would be tried and convicted in the media.
Then, in order to justify their ill-conceived trashing of Hollant in the press, all they needed was for police investigators to concoct evidence that he did something wrong.
For starters, as we have already mentioned, according to Sergeant Diana Roman’s own narrative page 4 of her Investigative Summary Excerpt, she stated that she arrived at the scene at approximately 5:25 p.m. and “made contact with Commander Hollant.” He advised her that he had been present on the scene before and after the shooting, but did not witness the actual shooting when he went to his car to get his binoculars.
Because Sergeant Roman had already “made contact with Commander Hollant” when she arrived, she knew very well that Hollant never claimed he wasn’t a witness at the scene. He did, however, insist he was not an eyewitness to the shooting.
Yet, she continued her investigation as if she had no first hand knowledge of his whereabouts, by disingenuously asking witnesses if they saw Commander Hollant at the scene, or if he announced himself as a witness.
Furthermore, as with every other officer who was called to the scene, Hollant’s presence automatically qualified him as being a witness. Why weren’t any of them expected to announce themselves as witnesses?
Just asking.
The bigger problem, however, is the method by which Sergeant Roman ran her investigation.
When a complaint is made against an officer, and an Internal Investigation is initiated, typically the complainant is the first person to be interviewed by the investigator. This is an important step in an investigation in order to assess the full details of the complaint before interviewing other witnesses who might or might not corroborate the allegations.
In fact, according to the Best Practices Guide for Internal Affairs published by the International Association of Chiefs of Police, “The complainant and witnesses should be interviewed by the investigator within 24 hours of filing the complaint, and preferably, within 24 hours of the incident. This allows the investigator to get information from the complainant and witnesses while it is still fresh in their minds and before they have an opportunity to taint their memory by second-guessing, talking with other witnesses, speaking with an attorney, or even being contacted by the subject of the complaint.”
In this instance, since the Florida Department of Law Enforcement (FDLE) took over the investigation of the police shooting and the Hollant IA was tolled, or suspended, until its case was completed, it was impossible to conduct interviews within that 24 hour window.
The IA investigation of Commander Hollant did not start until five months later when the FDLE turned its files over to the NMPD on December 20, 2016.
That gap left plenty of time and opportunity for memories to be tainted … and stories to be concocted.
What’s really interesting is that in accordance with the Florida Officers’ Bill of Rights, and specifically Florida Statute 112.532(6)(a), with very few specific exceptions, “Notice to the officer must be provided within 180 days after the date the agency received notice of the alleged misconduct,” one of them being “during the time that any criminal investigation or prosecution is pending in connection with the act, omission, or other allegation of misconduct.”
But, here’s the thing.
Sergeant Roman stated in her Investigative Summary that “this investigation was tolled at the request of FDLE … pending the completion of their investigation of Officer Aledda’s police-involved shooting.” She also wrote that it was “tolled pending review by the State Attorney’s Office (SAO).”
According to Florida Statute 112.532(6)(a)(1), “The running of the limitations period may be tolled for a period specified in a written waiver of the limitation by the law enforcement officer…”
Additionally, according to Florida Statute 112.532(6)(a)(2), “The running of the limitations period is tolled during the time that any criminal investigation or prosecution is pending in connection with the act, omission, or other allegation of misconduct.”
Why is this important?
Commander Hollant’s attorney, Michael Joseph, confirmed that his client never waived his right, either verbally or in writing, to his 180 day notification period, nor was his client at any time under investigation by the FDLE.
Notably, the FDLE’s sole role was to investigate “Officer Aledda’s police-involved shooting.” Nor were they ever investigating any allegations with an “act, omission, or other allegation of misconduct” by Commander Hollant.
As for the “pending review” by the State Attorney’s Office, Commander Hollant was cleared on August 2, 2016, per a Close Out Memo issued by Chief Assistant State Attorney Jose Arrojo and Deputy Chief Assistant Attorney Howard Rosen, who emphatically concluded that “Commander Hollant did not lie.”
As such, Commander Hollant’s 180-day period should have begun no later than August 2, 2016 and ended no later than January 29, 2017.
Since the North Miami Police Department’s Internal Affairs Case #16-06 was not disposed until May 24, 2017, or 115 days beyond the deadline of January 29, 2017, Commander Hollant’s Officers’ Bill of Rights was clearly violated.
Just saying.
To make matters worse, since Chief Eugene was the complainant against Hollant, he should have been the first to be interviewed by the IA investigator.
However, Sergeant Roman didn’t do so until April 7, 2017 – nearly nine months after the shooting – and worse, after all the other witness interviews were conducted. She then had the fortuitous opportunity to construct a case by cherry picking key excerpts of witness testimonies, and then use them to her advantage when she eventually got around to questioning the Chief.
In fact, practically every question that Sergeant Roman asked Chief Eugene was designed to get him to contradict his previous testimony to the FDLE, in which he clearly accused Larry Juriga of lying to him.
Despite her furtive efforts to trip him up, the Chief was absolutely adamant that:
- City Manager Larry Spring refused to listen to the police radio recordings which proved that Aledda did not shoot on Hollant’s command, yet relieved him of duty anyway (page 41).
- There was already friction between Commander Hollant and Commander Angel Rivera, who tried to get him to lie about his involvement in the incident in order to clear Aledda (page 44).
- Larry Juriga, Angel Rivera and Sergeant James Mesidor all had a personal vendetta against Commander Hollant, and were anxious to talk the State Attorney’s Office into filing criminal charges against him (page 45).
- Even though Larry Juriga insisted that Aledda opened fire on Hollant’s command, Chief Eugene realized it was a false accusation once he listened to the police recording (page 47).
- And, after he listened to that recording, the Chief came to the realization that Hollant wasn’t the one who was lying … it was Juriga. (page 48).
No contradictions there, huh?
So much for City Manager Larry Spring’s claim that “the Chief has made conflicting statements in his sworn testimonies.”
Ideally, a police department’s Internal Affairs division should be free to operate independently from any outside influences, including the administrations of both the department and the city.
Unfortunately, in its trumped up case against Commander Emile Hollant, IA investigator Diana Roman has allowed herself to be manipulated by:
- Assistant Chief Larry Juriga and his crony, Commander Angel Rivera (more on their roles in future blog posts);
- City Manager Larry Spring, who was aided and abetted by Deputy City Manager Arthur Sorey; and
- The conveniently installed Adam Burden, who was hired to engineer the city’s desired outcome in its witch hunt of Commander Hollant.
It’s glaringly obvious that the scapegoating of Commander Hollant was nothing more than a devious plot cooked up by all the above conspirators to take the focus off Jonathan Aledda and cover up for their own incompetency.
As a bonus round for Team Juriga, as soon as he was appointed as the acting chief, he reinstated Natalie Buissereth as the department’s PIO so she could again leak misinformation to the media in an attempt to sway public opinion.
Talk about a perfect storm!
In its Best Practices Guide for Internal Affairs, the International Association of Chiefs of Police stresses:
“Sworn officers hold awesome power. We have the unique authority to remove a person’s freedom and to use deadly force. And although the nation’s majority believes we use these authorities appropriately, there are those who believe that the police take advantage of and abuse their power on a routine basis. An internal affairs investigative process is meant to ensure that department policy and procedures are followed and that all department employees follow agency standards of professionalism.“
How can North Miami residents have any trust in its own police department when its Internal Affairs division has already demonstrated its own failure to follow policy and procedures, and a complete lack of professionalism?
More importantly, if these corrupt high-ranking officers of the North Miami Police Department would go to such lengths in order to frame a fellow officer by falsely accusing him of wrongdoing, how far would they go to destroy ordinary civilians?

What is your background in? Were you a police officer or ever worked in an agency?
I have never worked in the public sector, nor have I ever known anything about police work until I started blogging. However, since I’ve been a paralegal for almost 40 years, learning about this stuff came easy to me. I’m also pretty good at research, and I’m fascinated with solving puzzles. Come to think of it, I would have made a great detective. Guess I missed my calling.
I’m being told that Juriga is in line for the Chief spot. This comes from NMPD officers.
