Oh, HELL NO! Just how corrupt is the North Miami Police Department? Words fail us!

The more we review the “evidence” that North Miami Police Commander Emile Hollant is guilty of “Obstruction of a Law Enforcement Investigation by way of False Statements,” as charged by the Internal Affairs Disposition Panel, the more we’re convinced that he was set up.

Since we’re just scratching the surface, this blog post is just a preview – a teaser, if you will – of the actual evidence  that will unequivocally prove that Commander Hollant was targeted as a scapegoat within days of the shooting of Mr. Charles Kinsey by Officer Jonathan Aledda.

Hold on to your hats, folks.  What you’re about to read will blow you away!

Let’s start with the narrative of Detective Perez, which begins on page 48 of the NMPD Initial and Supplementary Reports (item 7 on the “transparency” portal).

Detective Perez stated that at approximately 5:00 p.m. he “heard a call of a person with a gun…” and responded immediately.  He also noted he was unable to get a clear view of Mr. Kinsey and Mr. Rios “due to the distance,” and also because at some point a taxi was blocking his view.  Perez also stated that while he was on the scene he “heard two (2) gunshots.”

Let’s next take a look at page 4 of IA Sergeant Diana Roman’s Investigative Summary Excerpt (item 1 on the NMPD “transparancy” portal), in which she states that she arrived at the scene at approximately 5:25 p.m. and “made contact with Commander Hollant…”  When she asked him if he had seen anyone recording the incident, he told her that “he had gone to get a pair of binoculars during the incident,” but “at one point” he noticed some people recording it from a nearby apartment complex.

Both Sergeant Roman’s and Detective Perez’ statements are critical to Commander Hollant’s defense because, as you shall now see, both of them were contradicted by Detective Gaudio’s testimony, who was initially tasked with interviewing all the witnesses.

Pay close attention to Detective Gaudio’s narrative, which begins on page 69 of the NMPD Initial and Supplementary Reports.

The Scene Entry Log (item 9 of the NMPD “transparency” portal) reflects his arrival at 5:40 p.m., at which time he showed up “to investigate to investigate a police involved shooting that just occurred.”

Upon arriving, he “made contact” with Detective Perez, Sergeant Reid, Sergeant Mesidor, Commander Hollant, Chief Eugene, and Assistant Chief Juriga.

Bypassing Perez, Reid, Mesidor, Eugene and Juriga altogether, Detective Gaudio went straight to Commander Hollant to ask if “he was present and what had occurred.”

Gaudio claims  that Hollant “stated he did not and had just arrived.”

Gaudio then claims  that Detective Perez “stated he arrived after the incident occurred.”

WAIT, WHAT?

Whoa!  Hold on a second.

Let me get this straight.

By his own admission, Detective Perez stated that he arrived on the scene shortly after 5:00 p.m., but before the shooting because he “heard two (2) gunshots.”

By her own admission, Sergeant Roman stated that she arrived at approximately 5:25 p.m. and immediately “made contact with Commander Hollant.”

Then along comes Detective Gaudio about 15 minutes after Sergeant Roman arrived, and according to her own words, Commander Hollant was already on the scene, and had left to get his binoculars when the shooting took place.

And yet, somehow, Gaudio claimed  that Hollant said he “had just arrived” even though Sergeant Roman had already “made contact with him” fifteen minutes earlier.

Even more incredible, Gaudio claimed  that Perez said he “arrived after the incident occurred,” even though Perez already testified that he “heard two (2) gunshots.”

OH, REALLY?

That’s some fine detective work there, Mr. Gaudio!

We’ll go one better.

The entire premise of the bogus Internal Affairs investigation of Commander Emile Hollant is that he “obstructed” the Aledda shooting investigation by giving “false statements” to investigators.

Commander Emile Hollant was on the scene of the incident and even though he heard the gunshots, he was not an eyewitness to the shooting.

But, according to his accusers, he didn’t “announce himself as a witness,” and therefore, “lied about his involvement in the incident.”

Ironically, Detective Perez was also on the scene of the incident and, like Commander Hollant, even though he heard the gunshots, he was not an eyewitness to the shooting.

But, unlike Commander Hollant, Detective Perez apparently didn’t have to “announce himself as a witness.”

In fact, Detective Perez went on to become one of the NMPD investigators of the shooting.

Funny how that works.

But here’s the best part.

Sergeant Diana Roman was well aware that Detective Gaudio’s claim  that Hollant said he had “just arrived” was a blatant lie since she herself already stated that she “made contact” with Hollant fifteen minutes before Gaudio showed up.

And yet, not only did she conduct the Internal Affairs investigation of Commander Hollant…

She prepared the 47 page Investigative Summary

And signed it on May 4, 2017…

As her sworn statement…

  2. Mrs.kienzle I love reading your opinions for years. I even enjoyed reading them than the Miami Herald. Because yours makes a lot of senses lately a lot of people have none.But I really don’t think it is not only the Police Department that is corrupted but the entire city Hall. It is a matter of time before they start to uncover them one by one. From time to bottom. It is a shame to say. But I ate to sound like a broken record but watch and see just like Opa Locka and many more other cities around the state of Florida they are no good liars,thieves,etc. we just have to seat and watch the movie.God Bless and keep on writing those wonderful articles.

  3. The word “immediately” does not appear in Sgt. Roman’s report. She wrote she arrived at 5:25. She then wrote “While at the scene” she made contact with Cmdr Hollant. You have drawn a baseless conclusion.

    1. Yes, the word “immediately” was mine.

      However, it stands to reason that, as a so-called “professional” police investigator, Roman would “immediately” start asking questions of the commanding officer already on the scene. I could be wrong, but I’m pretty sure she didn’t stand around filing her nails before gathering information.

      When questioned, Hollant told her he had already been present at the scene but left to get his binoculars from his car when he heard the gunshots.

      When Crack Detective Gaudio arrived 15 minutes later, Hollant had already been questioned by Roman, who had already been advised that he had been present at the scene.

      DUH!

      Dude, it’s not rocket science. Maybe your Crack Detective should have gotten his story straight before leaving a paper trail.

      Ergo, my conclusion is not baseless.

      Hence, your argument is invalid.

Jackson, or whomever you are….Lets use your words, “While at the scene.” Sergeant Roman stated that on the 18 of July 2016, (regardless when,) she met with Commander Holland who told her he was there. Sergeant Roman is now a witness for Commander Hollant being on the scene of the shooting. The beauty of her notes, not my opinion or anyone else, is a fact that she wrote as true. PERIOD.

  4. As a recently retired officer from a different department I must ask the city manager, commissioners, and mayor…
    How do these “officers” still have a job…??? Negligent retention will be something that many defense attorneys will use in the future, the residents will be the ones that will have to pay for City Hall’s blunders, which will lead to the eventual dismantling of NM as a city from the many millions paid out out in lawsuits or having the state take over and appointing the Miami-Dade Police Department to police the neighborhoods… Unless the city officials start firing everyone involved in this incident..
    They need to fire the high ranking police officials and the officers that were in cohoots in this sham…

  5. The internal affairs investigation is only including the evidence that supports Team Juriga’s agenda. At the city forum a resident brought up other evidence that exonerates the commander but according to the city they are more interested in following a process (and faking like they’ve found a solution) than they are in sharing the truth. How long are they going to drag this out? As a resident of the city I am scared!! My safety and wellbeing comes second to the city’s image.
