move along citizensWhen I wrote that North Miami Beach EX-Mayor Myron Rosner’s felony trial had been continued for the sixteenth time, NMB resident and former council member David Templer tried to take matters into his own hands.

He sent an email to the Florida Department of Law Enforcement, the Federal Bureau of Investigation and several individuals at the Miami Herald, including the editor.  David wrote:

Gentleman and Ladies:

Perception is reality.  It appears that there are high level favors being done in the Miami-Dade courthouse.

Myron Rosner is the former mayor of North Miami Beach and his wife Sarah Zabel is an 11th Circuit Judge.  Several years ago Myron was arrested and charged with various felonies and misdemeanors related to his campaign for mayor.  These charges result from what is at the heart of our democracy…voting and elections.

I am told there have been more than FIFTEEN (15) continuances of the trial proceedings. To date, the charges are no closer to being tried than the day he was arrested.  WHY?

Is Kathy Fernandez-Rundle asking her prosecutor to be cooperative and casually let this thing ride?

Is the presiding judge in the criminal case content letting this case sit idle so that there is no scrutiny from Judge Zabel or other members of the bench?

What the heck is going on?  This is exemplary of a system where common citizens can have NO faith in justice being served…regardless of whether he is acquitted or convicted.  This is exemplary of a system where the wealthy or powerful get favors that the less wealthy and less powerful don’t get.

Respectfully, this should be thoroughly investigated.  If we have corrupt judges presiding over or corrupt State’s Attorney prosecuting corruption cases, then all is forever lost.

Please take control over this.  Please.

While the FBI and the Miami Herald ignored his plea, the FDLE responded to his email.  Not that “THE AUTHORITIES” would actually do anything about this blatant corruption (and favoritism) in the State Attorney’s Office, but at least the agency did write back.

The email from the Florida Department of Law Enforcement said:

Your recent email to the Florida Department of Law Enforcement (FDLE) was forwarded to the Office of Executive Investigations (OEI) for review.  In your correspondence, you alleged corruption involving State Attorney Kathy Fernandez-Rundle, prosecutors with the Eleventh Judicial Circuit, and the presiding judge in a criminal case against former North Miami Beach Mayor, Myron Rosner.

Upon review, it was determined that your issues do not warrant an investigation by FDLE.  Therefore, you should address your issues with the Eleventh Judicial Circuit for review and any action they deem appropriate.  In regards to the presiding judge in the criminal case against Myron Rosner, your complaint would need to be addressed with the Judicial Qualifications Commission. The FDLE was “sincere” alright – about not getting involved!

I hurt myself laughing when I read, “Therefore, you should address your issues with the Eleventh Judicial Circuit for review and any action they deem appropriate.”

In other words, the FDLE is expecting the Eleventh Judicial Circuit to police itself.

Think about that for a minute.

That’s the same thing as telling corrupt State Attorney Katherine Fernandez-Rundle to investigate her own office.

Yeah, that would work.

In the meantime, as expected, Myron’s Imaginary Trial Date #16, scheduled for August 27, 2015, never happened.

(Ironically, the Florida Elections Commission scheduled hearings on that same date to determine probable cause of the very felony charges he’s facing in the criminal court of the Eleventh Judicial Circuit.  I assume Ben Kuehne arranged to have those continued, too.)

Instead, the Court ambitiously scheduled Imaginary Trial Date #17 for September 2, 2015 which, of course, also didn’t happen.

But, on September 2, 2015, Imaginary Trial Date #18 was set for this Thursday, September 10, 2015.

More Imaginary Trial DatesWhile waiting for justice to finally (if ever) be served, try not to hurt yourself laughing.

  1. Laugh, cry or get really “p—ed” off! This is again some crazy stuff. Let me try breaking the law and see if they will “wait it out”. As for Mr. Templer writing to “everyone” and they’re making it seem like he has a wild imagination, maybe a petition with enough voters signatures might help. People across Miami-Dade County KNOW that the office of the State Attorney is corrupt.

  2. Unless you are concerned that justice is unfairly administered and that it depends on who you are, this should not concern anyone. Possibly our congressional representatives could use some muscle and clout to help get things moving but they too are elected and so I don’t have faith.

    1. Thank-You David and Steph for keeping this on the front burner. If it were not for you both, I feel the matter would never be continued. It would be just simply dismissed because they would feel no one is looking, which is apparently is Kuene’s game plan.

      He’s trying to wait you out.
